NYC resident tax and resident tax withholding are both part of a NYS tax return.

NYC tax liability is added to your New York State return when you indicate that you are a resident of NYC. If you do not indicate that you are a resident of NYC, the residency tax is not added to your tax return.

If you do not indicate that you lived in NYC when preparing your tax return, all of your NYC taxes withheld from your pay will be refunded to you on your New York State tax return.

There's no separate form. You'll have $0 in resident tax added, and your withholding (as typed in when you enter the W2) will be added as a payment. As such, it'll be built into your refund.

If you don't live in NYC, are you a NYC government employee? If not, why won't they stop the NYC withholding? Lots of people work in NYC and don't have NYC taxes withheld.

Ok, so hopefully employer stopped withholding NYC, correct?
