File for taxes in Virginia or Nevada?

I am helping my daughter file her Federal and State taxes for the first time. But here is her situation; she has lived in Nevada for her college years, but as a resident of Virginia. Nevada does not allow out-of-state full time students to be residents of their state. In 2021, she both attended school (in Las Vegas) and worked (in Las Vegas), making enough money to meet the threshold for filing a tax return. Her federal filing required payment to the USG a total of $78.

 

The question is; in which state is she required to file? She doesn't seem to fit the Turbotax profile for a Virginia filing and Nevada doesn't collect state income taxes.

 

What should I do for my daughter?

You would file a Virginia resident return for your daughter. Per the State of Virginia, if you maintained legal residency in Virginia, but attended school in another state, you are still considered a Virginia resident and must file Form 760. If you had income in the other state, you may be required to file in that state also. Since Nevada does not have state income tax, you do not have to file another state return.

NV has no state income tax.

Now to attempt completing the Turbotax Form 760 for Virginia....fingers crossed

Thank you LenH!

I was able to complete the Va Form 760 straight away...easy peasy. My daughter is not so happy with the dollars she needs to shell out but the deed is done.
