OK, I have two different opinions here. one from a tax expert and comments from two others.  It seems to me that I should not have to pay taxes on  the atty fee amount, because that money will produce double taxation. One from me and the other from the atty whom I paid.  But it is included in the box 5 amount.  I will contact the IRS to be sure.
