Is it possible to file taxes if our baby doesn't have a social security number yet? He was born in Canada and already has his US passport.

We need to file our US taxes now. We had a baby this year (US citizens living in Canada) and haven't been able to get his US social security number yet. Should we file for an extension while we try to get his Social Security number or just file and not claim him this year?

What do you mean by "had our baby this year?"   If your child was born in 2025, you claim the child next year on a 2025 tax return.  You cannot claim the baby on a 2024 tax return unless the child was born in 2024.

 

It is too late to request an extension---you had to do that by April 15, 2025.   You cannot claim your child and get the child tax credit unless the child has a Social Security number, so if you want to claim your child as a dependent then you should wait for the SSN.   If you are getting a refund or do not owe tax due, there is no penalty for filing past the deadline.   If you owe tax due, you are late and will be subject to late penalties and interest owed.

Since you are out of the United States you can still get an extension to October 15 for filing your 2024 U.S. tax return, if you need it. Because you are out of the country you already have an automatic 2-month extension to June 16. To get an additional 4-month extension to October 15 you have to file Form 4868 with the IRS.


The extension is only for filing your tax return, not for paying any tax that you owe. Payment was due by April 15 in any case. If you will have a payment due on your tax return, you can reduce the penalty and interest for late payment by sending a payment with Form 4868 or making an extension payment with Direct Pay on the IRS web site.


If you are using the desktop TurboTax software you can use TurboTax to fill out Form 4868 for the additional 4-month extension. You cannot use TurboTax Online to request the additional extension. If you are using TurboTax Online the simplest thing to do would be to download Form 4868 from the IRS web site, fill it out yourself, print it, and mail it. Be sure to check the box on line 8 to indicate that you are out of the country.


To fill out Form 4868 for the 4-month extension with the desktop TurboTax software you have to go through the "File an Extension" section of the Step-by-Step interview twice. Go to Federal Taxes > Other Tax Situations. Under Other Tax Forms click the Start button for "File an extension." The first time you have to select the option to "prepare an out of country automatic extension statement." Enter the explanation and continue through the interview until you get back to the "Other Tax Situations" screen. Then select "File an extension" again and it will give you the option to "prepare an application for an additional four month out of country extension."
