you must use TurboTax cd/download desktop program to add a 5329 yourself.

If you are requesting a penalty  waiver and no dollare amounts are changing, you can file  paper 1040-X to add form 5329 after you e-File without Form 5329 using TurboTax Online.

 

when no amounts are changing, you can leave 1040-X lines 1-23 EMPTY.

Your explanation also goes on 1040-X Part III

Can I efile my 2022 tax return with form 5329 and a explanation sheet?

You will need a Form 5329 for either of these situations:

  • Early distributions from a tax-favored account
  • Excess contributions to a tax-favored account
  • Failing to take required minimum distributions ( I assume this is what you are filing it for since you are entering an explanation).

 

You can't e-file form 5329 in the Online version. You will need to use the CD/Desktop version and access "Forms Mode".

 

You can use TurboTax Live and ask an expert for help, by clicking here for information on Turbo Tax Support.

 

You can access Form 5329 as follows (If you are using the CD/desktop version):

 

  1. Enter "Forms Mode" and 
  2. Click on open form. Type in 5329.
  3. Choose 5329-T for the taxpayer (first person listed on your tax return), or 5329-S (for spouse - 2nd person on tax return).
    (Scroll down to Part IX line 52 and enter the RMD amount that should have been taken 
  4. On the appropriate line enter the amount of the RMD that was actually taken (zero if it was missed).
    Then in the box right under line 53 "Waiver of Tax Smart Worksheet" enter the same amount as line 52 (the RMD amount). 
  5. Then click the "Explanation" button and enter the reason (for missing the RMD or what your issue is) and your statement requesting a waiver.

    You will not pay any penalty now until the IRS determines if it will grant the waiver, then they will inform you if you owe the penalty.

 You can review your Form 1040, and see if any tax from Form 5329 is showing up on Schedule 2, line 8. 

 To view your Form 1040, while logged in to your return:

  • Click on "Tax Tools" on the left of your screen
  • Click "Tools" from the drop down menu
  • Click on "View Tax Summary"
  • Click on "Preview my 1040" on the left hand side of screen

 


If using the Online version you will have to prepare the 5329 manually. Download the 5329 form from the IRS website and fill it out the same as above. Print and mail your return with the 5329 form and explanation attached as described in the 5329 instructions.  Click here for Form 5329.
