My husband is active duty overseas. I currently live in the USA, how do we file our taxes together since he’s military and I have a regular job that’s not a government?

We are filing together I just don’t know how to go about it, or is it a different process since he’s active duty military and we not living in the same house currently.

MFJ. As you go through the program, it will ask about military. You can file a joint return and claim all of the taxable income. The program will know which questions to ask about the military pay to make sure you pay the right amount of tax. Your husband is still a resident of his home of record (probably where you are) planning to come home to you. He is just away for work. Depending on the state where he works, he may need to file a tax return just letting them know he exists in the state. If he has a civilian side job, he would need to pay state tax on that income.

 

Resident – residents entering military service remain resident for income tax purposes, regardless of duty station, until a change of legal residence has been made.

Okay so his home of record is SC and he’s stationed overseas. How do I go about that?

Also we just got married in December, what name do I file under if my name was changed this month to his last name?

When starting the TurboTax program you will tell it that you are Married Filing Jointly and that your address is your home address in South Carolina.  You will enter your name as it appears on your social security card (which should now read your married name).  There are several places that the program will ask you about your husband as active duty military.  Once you have answered all of the questions correctly TurboTax will prepare the joint return for you.

Tip: don't file under your married name until you've changed your name with Social Security.  If your last name on your tax return doesn't match your last name on file with Social Security, your tax return will be rejected.
