How do I prove primary residence for the capital gain exclusion? I am military and my home of record is Florida so my liscence,voter registration, and income taxes are from florida. I bought my first home SC in july of 2015 and lived in it until Jan 2017. I bought another home 20 minutes away in Jan 2017 and moved into it. But, I still pay all the bills( cable, water, electricity ) for both homes and I still frequently stay in both homes. I started to do short rentals on my first home on airbnb so i know those days wouldnt count. If I was to sell either of the homes after meeting the 2 year requirements in this manner, would i have the option of claiming either for the exclusion? How can the IRS determine which is my primary residence when I have proof that I pay bills on both homes and I own both homes, also my driver licence and my voter registration is from another state, the only difference is that my vehicle registration is with my first home.
