Generally, when payments are made in the course of a trade or business and the amount paid was over $600, then a Form 1099-Misc. should be issued. However, rental real estate activities are considered passive activities so the filing requirements are not the same. In 2012 the law was changed and under the new law, you are not required to issue Form 1099-Misc. Please view this link for more information.
