We got a 1098-t for our Childs kindergarten tuition. Are private elementary schools supposed to give out 1098-t forms?

EDUCATION EXPENSES

Education expenses for grades K-12 are not deductible on your Federal return, whether for private, public, or home schooling, nor are the expenses for tutoring, after school lessons or after school activities, such as dance lessons, sports, etc.  Some states allow deductions/credits for K-12 education and/or home schooling expenses; if your state has these deductions available, you will be prompted to enter them when you prepare your state return.  (As far as I know, the states that offer any sort of K-12 deductions/credits are Illinois, Indiana, Iowa,Louisiana, Minnesota, and Wisconsin)

Thanks- we are in Illinois. I assumed that I can add that information in the Child Dependent Care section where the expense for k-12 tuition is eligible. I was under the impression that the school should not have issued this 1098 since it is not a university.

You cannot claim this 1098T on your federal return.  Not sure what  if anything you can put on your IL return for kindergarten.
Kindergarten does not count as "childcare" for the childcare credit on your federal return, unless you paid a separate fee for before or after school care so you could work.
