Student loan interest

I have a student loan that's in my dads name but I have been paying the loan because it was for my school. I haven't been his dependent since 2013. Am I still able to use the 1098E on my taxes? Or would he?

Student loan interest

Neither of you is able to claim student loan interest at this point, unfortunately.   You must be legally obligated to pay the loan in order to deduct it (your name must be on the loan). Your dad must actually make the payments in order to deduct it on his tax return.

Note: If your name was on the loan and parent paid it, you would have been able to deduct it since you are no longer claimed as a dependent.
