If you don’t have a green card and spend at least 31 days in the U.S. during the current tax year and a total of 183 days during the last three tax years (inclusive of the current tax year), you’ll usually satisfy the physical presence test and are also treated as a resident alien. You could then use TurboTax to file a tax return.
Click this link for detailed info on whether you qualify to file as a Resident Alien.
Still unsure if you’re a resident or non-resident for tax purposes? Check with our non-resident tax partner Sprintax who will be able to determine your residency status and prepare your non-resident return.
