I noticed my Home & Business TurboTax this year (2023FY) didn't generate California Form 568 for my SMLLC. It did generate the form last year. What happened, where is it?

The Federal Return is correct and contains all the same forms as the last year, but California return didn't generate the LLC return form 568 nor the FTB 3522.

I noticed my Home & Business TurboTax this year (2023FY) didn't generate California Form 568 for my SMLLC. It did generate the form last year. What happened, where is it?

TurboTax generates Form 568 when you complete your California tax return for a Single Member LLC.  Follow the steps below:

 

  1. Open  TurboTax
  2. Go to State Taxes
  3. TurboTax guides you through the interview and when you get to Business Summary topic Select Edit
  4. Complete the entries for Form 568 - CA requires you to e-file Form 568 and Creating Form 568.

I am using Turbo Tax 2024 Home and Business. I don't see a "Business Summary' option under state taxes.

How can I get Turbo Tax to create a from 568 for me?

Yes, TurboTax will complete Form 568 under the California State section. Follow these steps:

 

  1. Open your return and click on State Taxes.
  2. On the California Taxes page, click Edit beside Income and adjustments.
  3. Under Business, click Start/Revisit beside Business Profit or Loss Adjustment.
  4. Click Edit beside the business you need to report on Form 568.
  5. Click "yes" that this business is owned by a Single Member LLC.
  6. Continue after reading the Form 568 information.
  7. A sub-form will appear. You need to complete any boxes highlighted in red.
  8. If this is the first year to file Form 568 for your SMLLC, be sure to check the box on Line H for "Initial Return" and the box under Line 2 for "First Year Exemption Smart Worksheet." These answers will exempt you from the franchise tax this year.
  9. Note the checkbox at the bottom of the form if you are not eligible to e-file Form 568.
  10. In most cases, you will not need to complete sides 4-5 or 7. 
  11. When you reach Side 7, you can print Form 568 if you need to mail it.
  12. Follow the instructions for the Payment Voucher.
  13. Continue to the end of the section.

If you are using TurboTax for Desktop, you can view the completed 568 in Forms Mode.
