IRS EIN was granted on 12/20/2021
Articles of Corporation filed with Florida are effective 1/1/2022
There was no operating losses or income during the last 11 days of the month, do i need to file my 1120? There is also a date incorporated (Box C) on the 1120 which technically would put me into the next year, seeing as i did not receive my articles of corporation until the 1st of the year, does the tax year go by the EIN or the articles of corporation? The IRS is going to be looking for a return if an EIN was issued in 2021.
This is kind of what i assumed, Thank you for your response. Would i use the actual date of incorpopration then 1/1/2022, or the date of the EIN issuance, 12/20/2021?

You should not file for an EIN prior to registering your business name with your state in case you cannot use the name you plan. In your case, it depends if you filed for your EIN as a C Corp or if you filed as another entity (like an LLC) that is electing to be treated as a C-Corp.
If you filed for your EIN as a C-Corp then you need to file a 2021 tax return because you had an EIN and use your correct Incorporation Date. You will need to file your return by mail in this case as the e-file system will not accept a return for 2021 with an incorporation date after year-end.
If you received your EIN as another business entity (like an LLC for example) and your incorporation date is the date you elected to be treated as a C-Corp, then you do not need to file a return for 2021.

I understand that now and was under the impression that i required the EIN prior to registering the business with my state, luckily for me the name was not taken.
I filed the EIN as C-Corp and filed an election after the 1st for an S Corp, but have not received a response yet.
I did not know about the mailing in of the form, thank you for that information. I just noticed the EIN assignment letter actually states that i have to file the 1120 on 4/15/22 and the 941 on 4/30/22
On the 1120, do i need to fill out the additional schedules even though there was no capital going in or out of the company on the last 10 days of the year?
