Excess paid NYS FLI tax

On this year's New York State W-2 in Box 14 there is "NYPFL".  I have worked multiple jobs in NYS and have paid more than the maximum amount of NYPFL.  How do I get credit for this on my NYS return?  Thanks

The NYS tax return does not credit an overpaid NYPFL deduction.  You need to contact your employer and request they return the overpaid amount to you (for 2021 the maximum deduction was $385.34).  If they refuse you can file a wage deduction complaint.

You mentioned that there were a few employers, which explains the overpayment. Go to the most recent employer. He would be the one  liable to have it refunded.

I went by what you guys wrote here and from the FPL site's:

Who pays for the benefit?

NYPFL is entirely funded by employees. Employers may collect the cost of Paid Family Leave through payroll deductions. The maximum employee contribution in 2021 is 0.511% of an employee’s weekly wage with a maximum annual contribution of $385.34. This amount is be deducted from employees’ post-tax income and is appear on their paystubs as a post-tax deduction.

 

However, my employer responded in email with the amounts were "taken accordingly". Before I tried to get them to elaborate, I went back and called the NY FPL helpline. They referenced a list of questions and read aloud one where someone says they changed jobs and if the new employer is able to start deductions all over again. She indicated that deductions/coverage is per employer.

 

That makes sense to me and while it means I pay double for no coverage 😉 it is understandable since coverage is per employer. The "maximum" line on their page should be made more clear and saw maximum anual PER EMPLOYER.

 

You cannot get a "refund" and filing a claim will likely result in more ruffled feathers than anything good.

(Unless someone received a DIFFERENT answer from NY PFL helpline - always possible due to the "level of training" they get 😉 but her answer sounded reasonable.)
