Class action lawsuit

Why did I not receive an email notifying me of the class action lawsuit for filing with TurboTax? I used TurboTax every year and every year I qualified for free filing I did not know it.  Am I still included in the lawsuit?

Class action lawsuit

There is no class action lawsuit. There is a settlement agreement between Intuit and the attorneys general of the states. All of the information about the settlement payments is on the settlement web site. Note the following statements from that web site.


"Consumers to Receive Payments Automatically, Without Filing a Claim"


"The settlement is being administered by a third-party administrator, please do not contact Intuit [TurboTax] with questions."


You should also look at the Common Questions on the settlement web site.


The settlement applies to a very specific set of circumstances, and only to tax years 2016, 2017, and 2018. Any other years that you used TurboTax don't matter. If you are a "Covered Consumer" as defined in the settlement, you will automatically be sent a notice and a payment. You do not have to do anything to be included, and there is nothing that you can do. Most TurboTax users are not Covered Consumers. Here is the definition of "Covered Consumer" from the settlement agreement.


"Covered Consumer" means any individual, or individuals if a joint return was filed, who in Tax Years 2016, 2017, or 2018 was (1) eligible to use an Intuit IRS Free File Product; (2) began his or her tax returns using a TurboTax Free Edition Product; (3) was informed that he or she was ineligible to use a TurboTax Free Edition Product; (4) subsequently paid to use a TurboTax Paid Product, and (5) had not used the Intuit IRS Free File Product in a previous tax year.

Class action lawsuit

There are probably several other people trying to sue Intuit, because big companies are always a target for lawsuits, sometimes fair complaints and sometimes boloney.  

 

The settlement refers to specific customers during specific years, who qualified for the IRS FreeFile program (income under $34,000) but who were steered or persuaded or tricked into using a paid Turbotax version.  Turbotax knows your name and address and will mail a check automatically.

I’m guessing Turbo tax affiliates found a way to send all settlement notices to consumers bulk/junk mail folder smh..

For customers who meet all the qualifications, checks were sent directly to the address they used on their tax returns.
