You don't have to claim it, but if you would like to enter the full amount paid for childcare instead of a portion, then you would submit an amended return. If you decide you want to do this, follow the steps below.
To File an Amended Return:
1. Wait for your return to be accepted or rejected by the IRS
2. Log into your account, and at your tax timeline select your "2016 Tax Year"
3. Select to "Amend (Change) 2016 return" and
follow the directions

Only the parent that the child physically lived with more than half the year can claim the Child Care Credit and EIC. The Child Care Credit is work related and is only available to allow you (and your spouse if married) to work. If the child did not live with a parent then they could work without the care so the credit is not allowed.
