My wife currently owes Social Security as they are accusing her of overpayment which is completely false. We have a lawyer looking into it. However, they started garnishing her wages and ended up taking my entire tax return because we filed jointly (we didn't know they were going to garnish).
I filed form 8379 as an injured spouse to try to recoup my portion of the return. My question is, since we filed jointly, would the stimulus check likely be applied to the Social Security overpayment, or would we still potentially get a check? I know we don't know for sure yet, but based on previous stimulus packages. Any thoughts here would be great. Thanks.
