Will I get my refund with no problem if someone tried to use my dependents after I already filed and was accepted before them? I'm a pather, I filed early, was accepted on 1/17 and already received my state taxes. Also on my transcripts that updated on 1/31, I have the 150, 806, 766 and 768 code, Every Friday I've checked my transcript since then and it's still the same, that's a good thing right?...I also have the path message on WMR

Me and this person had a verbal agreement that I would use all of my dependents (my children) this year just like I did last year but I have a feeling they're going to try to use my dependents anyway.

If they enter the dependents on their tax return and try to e-file the return it will be rejected by the IRS.

 

If they print and mail their return with the dependents, the IRS will pay any refund based on the dependents.

 

However, since the IRS received two separate returns with the same dependents entered, the IRS will investigate.  Within a year you and the other party will communications in the mail from the IRS investigating this situation.  The loser of the investigation has to pay back any refund based on the dependents plus penalties and interest.

I heard that people can get a IP pin if their return was rejected due to another person using the dependent first and then file again and they'll be accepted, have you heard about this? Or regardless of this they still would have to file their return in the mail?

The tax return would still have to be mailed.

Oh okay, I thought if the person were to do the IP pin that they would hold my refund or something like that, Was worried about that so I definitely had to ask...Thank you for the clarification, I appreciate it.

As of tax season 2025, IRS has expanded the powers of IP PIN.

It would be worth a try.

 

You can opt in for a "enroll me for one-year-only"  IP PIN

I already had filed my tax return and was accepted on 1/17, Could I still be able to do that?

On first reading I misunderstood you posts. (It was late).

 

If you already filed and were accepted, another person can still file on paper with the same dependents.

IRS will have to contact you and/or the other person to find out who is entitled to claim the dependents.

That will possibly delay both tax refunds.

 

Tell the other person that you already filed. that may deter them.
