My 2019 refund rejected because My Dependent and SSA no. has already been claimed!  My Dependent(granddaughter) has been living in Sacramento CA with me and her mother since 2006. Never has she lived with her father in Tonawanda NY 14150. For some reason my Dependents father felt he could claim her on his 2019 Taxes without telling or asking any ones permission in California to do so. The dependent lives here in California the whole 12 months in the 2019 year. She did fly down in November for her Christmas visit with her dad like always.   I'm furious with him. Because I have claimed her all these years!  Can he legally do this?  She was only with him 2 months in the year?  What and how if anything can I do to stop him from getting MY refund, if he hasn't received it already?

You cannot stop someone from claiming a dependent they are not eligible to claim on their tax return.  You will have to print and mail your tax return claiming your dependent on your tax return.  If you are owed a tax refund the IRS will pay the refund.

Within a year the IRS will contact both parties to investigate why the same dependent was on the tax returns.  The loser of the investigation must pay back any refund plus pay penalties and interest.
