Filed injured spouse 1/29/2020

Was told twice my injured spouse form was accepted and everything that they needed was there, it's only been 4 weeks that's why I called twice to make sure because they had a deposit date of 2/26 which I know from experience is too early for injured spouse claim and now got my deposit and it was taken, just like I figured, so what now? They said they already had the injured spouse claim and that I was getting my full amount.

Your refund was taken was because you did not file the Injured spouse form with the tax return. Because the return was filed electronically it followed the normal IRS process.

 

The IRS has many departments and five computer systems. Your injured spouse form was sent to one department and because your spouse had a balance due your return was sent to another department. 

 

After the IRS reviews your Injured Spouse request, they will send you the part of the refund you are entitled to.

You may or may not be able to answer but I have a similar situation...what differs is, I e-filed my fed tax return via turbotax on Feb 2nd, which included my completed injured spouse form. This is my 3rd year doing so, therefore I am aware of how the process works, I know it takes 11-14 wks to receive my paper check for my expected full refund. For the past two years it worked out this way without any major issues. So this year I did exactly the same thing, and I do not expect to receive my full refund check in the mail until approx. April 15-20th.  Well the dilemma is two days ago (3/25/20) I received a direct deposit in my bank account from IRS fed tax Return for an amount that is less than half of the full expected amount that I should be receiving in a paper check next month. Unfortunately due to the current covid-19 pandemic, being able to contact a real person via the IRS number is IMPOSSIBLE, I have been trying for the last few days and cannot get through to anyone. My local IRS office is also not an option, their line goes directly to an automated recording and you cannot leave a message or speak to anyone. I am at a loss, I cant speak to anyone to see what is going on and how to get this resolved. I don't know what else to do, in prior years you could easily get a live person via the IRS main line and they would transfer me to the injured spouse dept and I was able to speak to a specialist and have my questions answered, but now that isn't possible. As of today, I have checked the status of my return both online and over the phone and both say that my return has been accepted and is still in processing. Any ideas???

According to the IRS, they are "continuing to process tax returns, issue refunds and help taxpayers to the greatest extent possible." Please refer to the following link for an update on what's happening.

I mailed this form over 12 weeks ago with no response. Is that normal?

Sorry---but normal does not exist.

 

MAILED RETURNS

Per the IRS website IRS Operations During COVID-19: Mission-critical functions continueThe IRS is not currently able to process individual paper tax returns. If you already have filed via paper but it has not yet been processed, do not file a second tax return or write to the IRS to inquire about the status of your return or your economic impact payment. Paper returns will be processed  once processing centers are able to reopen. 

 

 

 

If you mail a tax return (or a payment) to the IRS, it is a good idea to use a mailing service that will track it like UPS or certified mail so you will know it was received.

 

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s. 

 

 

TurboTax will not know anything about your mailed return, and will continue to show “Ready to Mail” on your account.  TurboTax will not know that you put your tax return in an envelope and took it to a mailbox.  TurboTax does not get updates on mailed  (or e-filed) returns.

 

When the IRS finally opens its mail and begins to process mailed returns you can check the status on the IRS site. https://www.irs.gov/refunds

Anything mailed in, the IRS hasn't touched. They said the think they have 10 million from the mail and they haven't even started opening them yet
