My now ex-husband deserted the family, but claimed one of the kids as his dependent on his taxes during our separation, so my electronic tax filing was rejected. My ex husband did not financially support the kids and only lived with the kids for 4 months that year. Supposedly, he corrected this by amending, but I still could not file for my refund electronically. How can I file for my federal and state refund? What documents do I need to submit to the IRS to support that I have the right to claim the kids as my dependents? And how long will it take the IRS to issue my refund? Thank you!

Once the return was filed with your dependents name and social, the IRS computers will deny any further attempts to file a return with the same social and name. At this point, you should file your tax return by mail.
This procedure may take the IRS sometime so please be patient!
In the package sent to the IRS, you would want to include:
1. A copy of the birth certificate of the child.
2. Any documentation showing that the child lived with you. (School records, Governmental records, medical records
3. A statement that makes clear that the child lived with you for a minimum of 6 months during the year
4. If the Ex was not in the home for the last 6 months of the year, documents showing that you paid for the home in which you and the child lived to declare Head of Household filing status
5. Any document that butresses the fact that you were the sole provider of your child
