 It depends. According to the IRS, "If your spouse is neither a U.S. citizen nor a U.S. resident within the meaning of IRC section 7701(b)(1)(A) and you file a joint or separate return, your spouse must have either a Social Security Number (SSN) or an Individual Taxpayer Identification Number (ITIN)".

 

This is contrary to what you were told.

Per your understanding what would be my filing status, and how should I go about "e-filing" ?

The only point I was trying to make is you can file Married Filing Separately if your wife does obtain a ITIN. If you are looking at Filing Married Filing Jointly, I would suggest filing Married Filing jointly.

 

In either case, you won't be able to file electronically in either instance without having a SSN or ITIN issued to your wife.
