I did my state e-file an process on hold til received a letter I filed married filing joint my spouse owes for fines an they are taking my entire refund. Can I change my filing

Yes, you can change your status.  Depending on the state you are filing in you may be able to change your filing status for state only.  If not, and you have already filed your Federal return you may need to amend that so your filing matches.   Also, you may have credits or deductions disallowed because of the filing status change and AGI or other rules.
