I have not been able to get any information, either from the IRS (message says there is no one there to take my call) or my state ORS; they haven't been given any updated guidance on what to do AND they haven't received ANY payments from IRS for stimulus checks, even though the letter says it was sent to them on April 15, 2020. It's all very frustrating and disheartening.
If you filed an injured spouse form with your tax return when you filed, that will be sufficient for your economic impact payment as well. However, it may take some additional time for it to be processed.
If you did not file one with your original return, you can file the injured spouse Form 8379 by itself, and attach a cover letter indicating that you are filing it in order to be relieved of liability in regard to your Economic Impact Payment. You will find the form as well as the instructions, which contain the address to submit the form, here: IRS Form 8379.
If you are a custodial parent waiting for payment that has been redirected, each state's processing time varies. Many have laws that require that they hold payments from joint filers in order to allow time for processing of any injured spouse claim.
Other than to contact your state's disbursement unit, there isn't any way to know the status of the payment and the IRS will not be able to give you any additional information at this time beyond the date payment was directed, and to where it was directed. They do not have any more information than that at their disposal at this time.
I did file the injured spouse with my taxes. I've filed it every year for the last 10 years and every year it's always a hassle. But thank you for replying.
@sus Thank you for the information because we have been waiting for an "Expert" to respond for awhile. Are you saying to reach out to the state the child support is in or the state in which we live (2 different states)? My husband tried calling NYS and they wouldn't even help him with his pin #. We originally received a letter last week addressed to both of us saying half of the stimulus money was taken and Monday we received another letter saying that the other half would be direct deposited and the letter was dated April 15th. Yet, we have not received any of the stimulus payment. Do you have any information or clarification on when the amount will be direct deposited or do we have to wait for everything to be completely processed? Also what about our income tax? My husband has no income and the 11 week processing window for the IS form would be March 13th for us. The tax transcript shows it was credited but not disbursed. Does that mean when the IRS is back up and running that they will issue a check for the refund?
Thanks for your help!
I couldn't agree more but I heard theres no is form an irs website it stated if u already filed one you dont need to again..this whole thing is stupid an upsetting especially if you are not the darn biological parent
Since your letter from the IRS indicated that half of the economic impact payment will be processed, I would expect that to not be affected by current closures. However, I don't have any idea about how long it may take to receive it. The only source for that information is the IRS portal, which as you have learned does not have complete information for all taxpayers.
Custodial parents awaiting disbursement of funds that were withheld can get information from the state that processes their parents.
Injured spouse information will have to come from the IRS, which, is frustratingly closed at the moment of course.
As for the credit on the transcript - these often will kick out checks automatically but since yours has not done so already, it sounds as if it requires some sort of manual processing which, again, requires that the IRS re-open.
New injured spouse claims of any time, when the IRS is open and fully operational, typically take 10-12 weeks to process so I expect that this is all, likely, going to take a bit of time to untangle itself once the IRS resumes operations.
Occasionally the Tax Advocate Service (TAS) that serves your area can assist in expediting when the situation warrants, but right now they are limited in what they can do to assist as well since they have to work with departments within the IRS.
If you would like to contact your TAS representative you can look up the contact information for the office that serves your area here: Taxpayer Advocate Service
I have been issuing IS forms the last 4 or 5 years. My 2019 return was submitted but has yet to finish processing. I got a letter from the IRS telling me my portion of the stimulus was being used to offset my husbands back child support. So having filed an IS in previous years has not helped me. I have no idea what I am suppose to do now to get my portion of this stimulus, or any future stimulus payments that might happen.
What are my next steps?
You have to file a IS form every year. The past years don't count. If you didn't file one for 2019 then you need to go do that. Otherwise you will get your stimulus but it's going to be a couple months from now.
There is no other steps. File the IS form for 2019 and wait. If you already filed one for 2019 then do nothing but wait.
I was told by NY state child support that they don't receive the payments until about 3 weeks after it has been offset. It's probably the same way every where. We just have to wait.
My part of my stimulus check was taken by my husband's back child support I'm not sure how to get my part back
But how do u do specifically for the stimulus? I file injysred spouse out of Washington for the last 10yrs and csnt get any input on how I can get any of that he do t even work I get he owes and ingrt we filed together but still how? They should of left this out of the bill since the mothers and kids are getting something or have done something else this is a state of emergency and they are saying that the parents that are behind innoayement for what ever reason dont matter they can just drown during this there gotta be a way to file a complaint petition or something lol
While she might be telling the truth on her end I contacted the child support office an they stated irs has to fix it so which way to go ain't even accurate
So I take just like taxes will just take time for them to process it?
Wow.. so just like that we that have no fault and have zero accord with like in my case is a debt incurred way before we even met. Me and my kids are impacted..so to the government we don’t matter we’re just going to have to sucked it and wait til whenever..in the meantime we’re enduring the crisis with everyone esle
so I haven’t even received my tax refund nor my stimulus...I was in the batch filed I. Late January
it’s just really hurtful and extremely disappointing
