It's NOT RIGHT! IT'S TOTALLY WRONG! No child should suffer either way. But the one living in the home also suffers for past obligations. I understand to a point with the offset of taxes. But the stimulus, no way! Each home would receive a stimulus check of their own. Especially if ex spouse files for the other children.
@Mhulsey2506 I am now starting to think this was a turbo tax era as well. They didn’t report to the IRS the people that filed and already got approved. And also those that always file this way.
True! Only reply I had was to write congress! As to complain about the CARES ACT! Might be only hope any of us have. For many years child support offices have taken lots or money and have made spouses suffer along with any new children born into the situation. Very sad! Lots of times the children of the ex never see the money. Like in our situation! She committed fraud time and time again.

The IRS updated this a few days ago, so this means another form isn’t needed. And I hear rectification should be in 8-11 weeks or sooner.
This is the first year that my husband and I filed together and I didn’t know about the injured spouse claim so I had to amend my taxes and fill out a amended return. I have yet to hear anything from the IRS about this and now they have taken the stimulus check for back child support. My children and I have nothing to do with this debt and it was all my income.

I received two letters from the IRS stating that they had the stimulus payment intercepted by the Tax Offset company. I contacted the Tax Offset and the Child Support Bureau for my state. The representative through the Child Support Bureau told me to file another Injured Spouse form in order to have my funds sent back to the IRS. When I asked about already filing the form, he stated that he was told to file a new form. The representative stated that this may change as things continue along, but for now, that is what he was told to do.
I already filed this form when I filed my 2019 taxes, but it did not stop the money from going to child support. My husband is the one who owes the child support. They took the entire amount and sent it to the child support bureau; I have two separate deposit numbers showing that they did. As I used TurboTax to file my taxes, what do I do? Do I just refile the same Injured Spouse form from my original 2019 taxes, or do I file a new one? Because, I was told I had to file one, or I was going to lose the money. I know this is something new with the stimulus payment, but it took the IRS until the middle of last week just to finish processing my return and separate our refund appropriately to pay his child support arrears. I am scheduled to finally receive my original refund today, per my tax record on IRS.GOV, but the Santa Barbara Bank has not refunded my money yet.
I have another question. Since my original filing and acceptance date was February 7th, I had to wait the 11 weeks for the IRS to process my refund. Due to that, TurboTax deducted the fees that I owed when I filed, as I authorized the payment to be paid through my refund. Since the fees have already been paid, do I have to still lose the $40 from my refund for having Santa Barbara Bank process the payment? Any help is appreciated, as I am beyond stressed out due to all this, and I have been anxiously awaiting this money to catch up on our bills.

Yes. Complete the form and attached a copy of your 2018 w2.

@Shadrake If you have already done the injured spouse form you don't have to file it again.
@BreeStroh4 did you also file an injured spouse for your state??
