If you were married during the year and your spouse does not want to file jointly then you should file as married filing separately. If you were legally married on the last day of the year, then you will need to file your return as married. With the married filing separate filing status, you must file a tax return if you earned even $5 for the year. Please view this TurboTax FAQ for more information.
