Green Card holder Filing from Europe

Hi,

My brother and his wife got their Green Cards in June 2022 but they are still in Europe and they are in the process of relocation. Their incomes for 2022 was all from Europe.

1) Do they need to file for state tax too? Which state do they need to choose? He got his driver license when visiting me in my state and he has a bank account here too BUT obviously he is not living here.

 

2) They have a house in Europe which they are paying mortgage. Does TT help with that too?

1) If they are not living in the US and has not set up a home or earned income in any state in the US, then they would not need to file a state return.

 

2) If they are not living nor working in the US, they would more than likely take the Foreign Earned Income Exclusion or Deduction so they would not need to worry about deducting mortgage interest as an itemized expense.  What they will need to do is walk through the foreign income section.  

To get there, they would take the following steps:

  • Federal
  • Income
  • Show more next to less common income
  • start next to Foreign Earned Income and Exclusion.

Hi again,

So he completed his taxes but TT says he is not qualified for e-filing because there are boxes in 1040 with zeros and he has to mail it. Is that true?

That is a possibility.  We can't see the return in this forum but with an indication of the specific e-file error or clarifying what areas are specifically blocking the e-file someone may be able to assist with the entries to allow an e-file.
