‌If you file a joint return as a qualifying spouse, and your spouse owes a debt, the government may try to reduce your refund.  You can include a "Request for Injured Spouse" Form 8379 with your tax return in TurboTax.

 

The IRS has a tool you can use to see if you qualify for injured spouse relief.  Use this link and Click on Begin: Can I or my spouse claim part of a refund being applied toward a debt owed by the other spouse?

 

You may be eligible for injured spouse relief if:

  • You filed a joint return with your spouse
  • Your tax refund was applied to your spouse's overdue debts
  • You weren't responsible for the debt
     

The section in TurboTax covers both injured and innocent spouse relief, so it is easy to mix them up. You are looking for injured spouse relief. Leave the questions regarding Innocent Spouse Relief blank if you only want to claim Injured Spouse Relief.

 

Innocent Spouse Relief protects you from paying additional taxes, penalties, and interest owed due to your spouse's errors or fraud on a joint return.

 

Injured Spouse Relief allows you to recover your portion of a joint tax refund that was seized to pay your spouse's past-due debts, such as child support, student loans, or other federal taxes.

 

You can get to that section of TurboTax as follows:

 

  1. Click on "Search" at the top right of your TurboTax screen and
  2. Type "injured spouse" in the search bar and hit Enter
  3. Next, click on the link that says "Jump to injured spouse
  4. Your screen will say Innocent or Injured Spouse Relief Do you want to claim Innocent or Injured Spouse Relief?
  5. Click on Yes
  6. Your screen will say Innocent and Injured Spouse Relief, enter 2025 for the year and Continue
  7. Your screen will say Your request for Innocent Spouse Relief. In the Box there is a Form, Select No in Box 1 and Continue
  8. Your next screen will say Let's see if you Qualify for Injured Spouse Relief. Check the state(s)  that apply. And Continue
  9. Your screen will say Tell Us More About Your Situation. Check all of the boxes that apply. And Continue.
  10. Your screen will say Tell Us More About Your Situation Answer Yes or No as applicable, and Continue
  11. Your next screen will say You qualify for Injured Spouse Relief if you qualify.
