We lost the use of our home for a year, and the insurance only paid 2 months rent of the 12, and we had to pay the moves, the utilities, the insurance, the rent, PLUS the cost of our mortgage, HOA, utilities and insurance on the condo we could not live in because of ongoing flooding. We could not sue - no lawyer would take the suit, and insurance would not cover us because it was a named storm that caused the initial flooding, plus the building defects had caused us to be part of a class action suit that was not settled. NO ONE WOULD help us and we were out all of that money until they finally began to make repairs. Is this the right form to use to try to recoup some of our loss and if not, where else do we go for what we need?? Thank you Judy
Unfortunately, you're no longer allowed to deduct such a loss. The deduction for personal casualty or theft losses has been suspended (eliminated) through Tax Year 2025, unless the loss occurred in a federally-declared disaster area and was directly caused by the disaster.
Please see the TurboTax Help article "What if I have property that was lost or damaged (a casualty loss)?" for more information.
