Hi, i am J2 dependent and my wife is J1 student. We both work in Miami university. According to university payroll services my tax status is resident alien and my wife (J1) is non resident alien.
1. Can i file as resident alien?
2. Can i put my wife together and file jointly?
3. Is there any rule that J1 should be the primary filer for taxes
Thank you

To clarify, you are a J2 dependent of whom?
Im J2 dependent of my wife. She is graduate student. I work as a laboratory technician with a valid work authorization
If you are on a J student visa and have been here for five calendar years, then you could be considered a resident alien. Your status is determined by your visa type and time here, not your payroll status as that could be incorrect.
If you have been here more than 5 calendar years, and are a resident alien, then you and your wife could both file a joint return as resident aliens. All of both of your income earned worldwide would then be taxable.
