My husband and I were married 11/2024. We lived in separate states until 10/24. Turbo tax is asking for his info in the state I lived in but he never did.

I lived in Maryland (MD) from 01/01/2024 until 10/04/2024 when I moved to Pennsylvania (PA). He lived in PA the entire year.

Maryland - file a joint return as part year residents and pay taxes only your MD income. His PA income is exempt. 

PA filing requirements show you will file a joint return, PA does not tax MD income based on NESTOA (North Eastern States Tax Officials Association) agreement of residency.

 

Because of the NESTOA, your marriage and dates, you may have to file a joint nonresident return with MD to get the income and credits to work out correctly. The goal here is for you to file a tax return with the accurate income and tax. PA has disallowed the part year credit in prior years and this was the work around.

 

The other options for filing do not apply to your MD situation. Filing Information for Individual Income Tax in MD:

  • Married couples who filed joint federal returns but were domiciled in different states on the last day of the tax year
    • If you are filing separately, see Instruction 8.
    • If you are filing a joint return, you must attach a pro forma Form 505 and Form 505NR.
  • Married couples who filed joint federal returns but had different tax periods
    • Joint return - Filing Status 2  OR
    • Married filing separately - Filing Status 3
    • If you are not certain which filing status to use, figure your tax both ways to determine which status is best for you.
  • All other married couples who filed joint federal returns
    • Joint return - Filing Status 2
