Mother claimed me as a dependent

My mother claimed to be as dependent but I was going to claim my own self and file myself. What would have if I file for myself although she already claimed me? Does the IRS get involved? I have my

W-2  and my 1098t tax form. I am a full-time college student. My mother does not cover any of my college expenses, I pay for those myself and I have proof to prove it.

If you are a full time student under the age of 24, do you provide over one-half of your own support for the year?  Not student loans or scholarships but from earned income from work, interest or dividend income or capital gains income from investments or savings?

If you both file tax returns with your SS number and name as a dependent on one and not a dependent on the other, then the IRS will get involved.   Your mother will have to prove that  you were her dependent or you have to prove you provided over one-half of your own support.  The loser of the investigation must pay back any tax refunds and tax credits received based on the dependency plus penalties and interest.

Usually there is no financial advantage to file for yourself.  The standard deduction for you  is the same whether you file for yourself or file as an dependent.  In tax years 2017 and earlier there had been an advantage.  

The IRS will get involved if your mother claimed you as a dependent and you attempt to file on your own.   They check SS numbers. 

See IRS Pub. 17 for education credits and who can claim them.  If you are under 19 years old at the end of 2019 I believe you have no choice but to be a dependent.

Only you can change your tax return, no one else.

If you have already filed the 2019 tax return and need to change your dependency status you will have to wait until the federal amended tax return, Form 1040X, becomes available on 02/27/2020.

 

An amended tax return, Form 1040X, can only be printed, signed, dated and mailed by you to the IRS, it cannot be e-filed. The IRS will take up to 4 months to process the amended tax return. Wait until you have received the tax refund or the taxes owed have been paid and processed by the IRS before amending the tax return.


On the Tax Home web page when the Form 1040X for amending a 2019 tax return becomes available there will be a link - Amend (change) return
