married filing separately

My spouse died in 2024 and we always filed married filing separately due to our different financial issues. Am I still able to file as married filing separately for the current tax year and it be considered legal?

Yes, you are still considered to be married for the entire year of 2024 (when your spouse died) as long as you did not remarry to someone else.  

 

You can choose to use Married Filing Separate or Married Filing Joint filing status for 2024.
