I apologize I asked the wrong question. I meant are CPA fees deductible as legal fees when you are suing your employer for monies owed to you.

We do not know the nature of your lawsuit nor whether any award you may receive could be income taxable to you.
Many individual plaintiffs will no longer be able to deduct the cost of attorneys’ fees associated with non-business related litigation. The Tax Cuts and Jobs Act of 2017 suspended many of those deductions.
