NO ... you must have a qualifying dependent on your return.

If you are single, unmarried, live alone and pay 100% of the bills can you claim head of household?

Probably not unless you have a qualifying person who you claim as a dependent. Here are the rules for filing as head of household: 

1. You are not married or “considered unmarried” on the last day of the year. You are considered unmarried if you lived apart from your spouse the entire last 6 months of the year.

2. If "considered unmarried" you file a separate return from your spouse.

3. You paid more than half the cost of keeping up your home  for the year.

4. You have a qualifying child (whether or not you claim the dependency exemption) or you claim a dependency exemption for a “qualifying person”  who is related to you and who lived with you in the home for more than half the year. An exception is a parent does not have to live with you to be a qualifying person.

I am just looking for clarification.  I have a no contact order against my husband.  I have lived in my house for 9 months without him, so I am "considered not married", correct?  Does this mean I can file Single and take the standard deduction, or Divorced/Separated?  Can I take the "full" standard deduction since I have been living in the house and keeping up on all the bills?  I did have my son living with me July - December 2024, and I paid all the bills.  Can I file HOH and put him down even though he was working and will be filing his own taxes?

If you are single, unmarried, live alone and pay 100% of the bills can you claim head of household?

Yes, you are considered unmarried and can file as Head of Household if all of the following are true:

- you and your spouse didn't live together at any point during the last six months of the year

- you paid more than half the cost of keeping up your home for your child, stepchild, or foster child for more than half the year

- you can claim your child as a dependent on your tax return

 

You mentioned that your son worked and will file his own returns. You'll need to ensure that he can be claimed as your dependent before claiming the Head of Household filing status. To be claimed as a dependent, he'll need to be either a qualifying child or a qualifying relative.

 

As a qualifying child, he:

- has to be under the age of 19 (or 24 if he's a full-time student)

- has to have lived with you over 6 months of year (excluding temporary absences)

- can't support himself

- can't be married filing a joint tax return

 

If he doesn't meet the rules for qualifying child, he may qualify as a qualifying relative.

 

As a qualifying relative, he:

- can't meet the rules above for qualifying child

- has to have less than $5,050 in gross income

- had to receive more than half of his support from you

Q. Does this mean I can file Single and take the standard deduction, or Does this mean I can file Single and take the standard deduction, or Divorced/Separated? 

A. No. You cannot file using "single".  Your choices are Married Filing separately or, in some cases, Head of Household (HoH). There is no such status as "Divorced/Separated". 

 

Q. Can I take the "full" standard deduction since I have been living in the house and keeping up on all the bills? 

A. You can take the full standard deduction for the filing status you qualify for.  There is no such thing as a partial standard deduction (except for dependents who also have to file a return). 

 

Q.   I did have my son living with me July - December 2024, and I paid all the bills.  Can I file HOH and put him down even though he was working and will be filing his own taxes?

A. No, unless July included July1st.  The qualifying dependent for HoH must live with you MORE than half the year. 

 

Q. Can I file HOH and put him down even though he was working and will be filing his own taxes?

A. No, if he made more than $5050, for the year, and was not a full time student for five months.
