You will not receive an income tax refund for filing a  tax return claiming a dependent.  Child-related credits are based on having income received from working.  In fact, if you had no income, how are you supporting yourself or a dependent?   Can YOU and your child be claimed as dependents by someone else?

The money you hear about people getting for just filing a tax return claiming kids requires them to  have some earned income (wages or self employment). Without earned income, they are not eligible for the "refundable" Earned Income Credit or Additional Child Tax Credit.  Both credits are calculated on the amount of earned income you have. No earned income means no "refund". A small amount of earned income means a small refund. The child tax credit does not "kick in" unless you have at least $2500 of earned income.

 

A child can be the “qualifying child” dependent of any close relative in the household. If you live with someone else, e.g. your parents, it may be better if they claim your child.

Instead, you could allow the non-custodial parent to claim the children.  Non-custodial parents are allowed to claim the child tax credit, but not the Earned income credit.

 

If you are a student, over age 23, and are not claimed as a dependent by someone else (e.g. your parent) you may be eligible for the up to $1000 refundable American Opportunity (tuition) Credit. That credit is not dependent on having either kids or earned income. You must be at least a half time undergraduate student. There's even a loop hole available to claim the credit, if you are on scholarship.

It’s like I’m getting different answers from some ppl.  My daughter and I stay with my mom and she thought she couldn’t claim me and her. Then the accountant said u can still file but I wasn’t comfortable with doing that since I didn’t have a on the books income. Can she can her and I or just the baby?

You originally said you have no income.  In that case, your mom can and should claim both you and your child.

 

Then you say didn’t have any on the books income.  All income is reportable. The IRS considers undocumented cash income (no W-2 or 1099-MISC), for work performed, to be self employment income.  It is also earned income for the refundable credits.  On the other hand, the IRS is suspicious of low amounts of undocumented income, that just happens to qualify a tax filer for refundable credits. You should keep good records of your income if you're going to claim it. 

 

Depending on how much income you have, your mom can still claim you (if less than $4200). In either case, it's optional which one of you claims the child.
