Sounds like the 2nd one is just to correct the first.   Just file the first W-2 and add the box 12 to it.

thanks for the reply.  i would agree but my employer uses Insperity for their payroll etc so i get a W2 from Insperity with their EIN and in addition this year i got a w2 from my employer with just this amount in 12a for HSA contribution and nothing on the W2.

i have neve gotten it this way before

The only EIN on a W-2 should be the employers EIN reguardless of who they use for payroll.

Is the EIN the same on both W-2's?

no the W2 from Insperity all my wages federal tax etc has Insperity's EIN.  the second w2 from my employer has my employer's EIN which is different.

You need to investigate this.      A W-2 from Insperity with their EIN indicates that you are an employee of Insperity.

It will appear that someone make an error in reporting this.     Talk to your employers payroll department to get it straightened out.

It seems rather odd that only the HSA would show up that way.
