Question is mainly to choose US residence or not, he is being in H4 Dependent Visa.

We are here in US from Sep'2011 continuously.

yes, you can claim the child tax credit as you are all resident aliens. Resident aliens are treated the same as citizens and permanent resident s for tax purposes
