If my income is 31,000 and my husband is 49,000 and our federal refund is 10,000 and state is 900 how much will child support take of my tax refund. Will they take away from my kids tax credit if I have three kids and most of it is the child tax credit
The IRS can seize any amount of the federal tax refund to satisfy the child support debt.
I filed injured spouse
Filed injured spouse
The Formula that the IRS uses is from
Injured Spouse's Separate Tax Liability | ÷ | Total of Spouses' Separate Tax Liabilities | × | Joint Tax Liability Shown on Return | = | Injured Spouse's Share of Tax Liability |
Separate Tax Liabilities are calculated using Married Filing Separate Tax Tables for each spouse as mentioned earlier. The form 8379 has instructions for breaking out the amounts for each spouse to be used in this calculation.
