Filed form 8379 with 1040 and was received by IRS on Feb 20,2015 - Transcript states it was processed on 3/23/2015 - haven't had any communication and can not seem to find a number for a live person on when I should expect it. This week ends 9 weeks.

If u dont mind my asking, Thats what these Forums are for however. .. why did it take so long to process,or for the Irs to accept it? The 20 of Feb is when you filed?? And they accepted on Mar. 23. And thats the date that matters! What do your transcripts say, maybe I can help. This process can be awful. I have been filing for 4 years with this, And every year, instead of waiting like the average for them to arrive whenever... I sort of chase down W2's!  I am making sure all forms Are 100% on point. Bc there is LITERALLY No Room for Error...Especially when dealing with IS-8379. It is an Over-Time consuming, sometimes life altering, usually almost always for most people; Awful Form! And 9 weeks sounds like a dream hun. And u and I happened to be on the same time course this year! This is 9 weeks for me as well.  Last year was the worst! We FINALLY got back our return after waiting 15 weeks and 6 days! And it could not have been at a worst time for me and my family. You can't even speak to anyone in the Actual Injured Spouse Department until it has been 12 weeks!! So but every other time. It's been 13 and 14 weeks! :( I'd kill for 9 weeks! Lol!!! But I'm confused about what your saying about talking to someone?  And what you are saying your
transcript says!?

Oh, I haven't received it yet.. I'm on the phone with the IRS, looks like they made an adjustment today, but was for the wrong amount and was for only about half of what was accepted on Mar 23. I went over the form 8379 with the CSR and he mentioned he agreed since I had 100% of last year's income, I was owed the full amount. He transferred me to the injured spouse department, but wouldn't release the phone number in case the call drops (still on hold and have spent 1hr 45min total time so far, about 30 was with the CSR). I filed with Turbo Tax Feb 19, received an email confirmation Feb 20th that the IRS accepted. I waited 3-4 weeks expecting an update where I read I could download transcripts for further details. Processing date lists March 23, 2015. Code 570:  additional action pending 3/23/2015 $0  Code: 768 Earned Income Credit  -$300  4/15/2015  Code: 766 Credit to Your Account -$1000 4/15/2015  Code: 806 W2 or 1099 Withholding -$5000 4/15/2015. Additionally, he mentioned it would take about 3 more weeks to finalize and release funds (this was prior to me speaking up on the adjustment amount and being transferred).

Why does it take so long?   Because injured spouse must be hand processed and anything hand processed in the IRS takes time - a lot of time.   Just the other day the IRS commissioner said that due to budget cuts 60% of all phone calls to the IRS either are never answered or hung up on and tax payers can expect long processing times due to lack of personal, so the 8-12 wee time last year might be much longer this year.

(Last year amended returns took about 12 weeks, this year the IRS says 16 weeks or longer).

It's crazy but you basically need a Level 5 clearance to get to that department! Thats what it feels like lol. I always wondered "Odd name for it considered what it's for...Injured Spouse"...Well after dealing with it for a few years I get it now! Bc it actually Hurts to deal with anything to do with this form. At least they have that, to protect any of the funds at all. But they have a terrible process or system they set up. That clearly isn't working, bc they are always a mess it seems every year!!. Just like I Am ALWAYS on The phone for about an hour and a half..minimum when trying g to even Contact the IRS. I don't have any code past. 570...so you are making progress, unless it's bc they are adjusting your return...which could he a bad thing. So Good Luck. Like I said it's an awful process. Especially if your experiencing any sort of Financial Hardship! So fingers crossed for the both of us...Let me know on here ehat happens with you, and i will do the same. I wil keep you updated as well with anything that's happening so u canmaybe see if it's true about being in the order they are recieved! 😉

Just finished up with the injured spouse department and they were so much easier and knowledgeable to talk to. He basically said my form was filed correctly, but with living in Texas, the spouse is entitled to half, regardless if you earned 100% or not. The money is considered communal property in which she has half, so they took half.  I recommend anyone living in Texas wishing to avoid paying off your spouses student loans to file head of household rather than married filing jointly.

@Steven1982 - Head of Household is for unmarried persons (or persons that did not live with their spouse at anytime during the last 6 months of the year).  It also requires that you have a dependent child.

Filing separately in a community property state is no better than joint since income must be allocated between both spouses and many credits are lost, including educational credits.

Community property states:  Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, or Wisconsin.

Any updates anybody??? My transcript says my refund will be done on the 11th of May, that's 11 weeks from when the irs received my injured spouse form. Hoping to get it this week but I won't hold my breath

1st posting on here. Mailed the form separately on 3-14-15. Transcript says claim received 3-29-15(code 971). Reversal of refund applied 4-15-15(-X,XXX.XX) Code 766.  Then is says code 971: Notice Issued 5-11-15. ? Any interpretations?

You asked me a question hun? Well unfortunately I have had to file this form with my joint return with my husband for the past 4 years ,this years will make 5 I think. So I am well adversed in taxes. The know how. And making certain the return itself before FILING is Solid and 100% on point. Bc with anything like this form.  Bc if the time it takes to file this particular form. Injured spouse: 11 weeks they say... but the truth is. It takes about 15. So plan on 3 to possibly 4 months. Anything sooner is a blessing. And you can't even call. Until 9 weeks have past. Some say 11 weeks. Each IRS rep is different. But you can only call the main number . U won't be transfered to THE INJURED SPOUSE DEPARMENT::until it's been that amount of time. Everyone has there opinion. I am telling you FACTS-- and what works the fastest for me....Make sure every single thing and box is 100% correct. DEFINITELY direct deposit the funds. That makes things 2 -4 weeks Faster!! And the bank account Must have your name!  .Last year was the fastest for us.  It was here in 11 or 13 weeks. So The thing is ours how to be manually gone over by an acct. In the I.S. department. Vs all computer. And the faster they can go is how it all boils down. So if it's all a complete match! Your golden they can be done as soon as yours hit the desk. Usually that day. They are in route as processed. And whatever you do...do not RELY ON WMR....bc it doesn't always give accurate results on my end. It will show false hope. I heard again..HEARD it works for some. But not us. Call once a week. And go off what the screen shows them. But I check it anyway. So Good Luck. Ifor u have anythingu need to ask me. Please don't hesitate...and make sure you reply directly to Me. On a forum....or if it's general I wont usually reply. Bc I can't with Life of mine always running. But if u ask Me. A question...I will respond. Again Prayers for me. I still haven't filed.
