Very sorry for your loss.  For the year that your spouse died, you can still file a joint return.  That way, you will get the married filing jointly standard deduction of $27,700 (+ $1500 for each spouse 65 or older) which will lower the amount of income you are taxed on.

 

 

In My Info, you will need to indicate that your spouse died. When her name is in My Info,  there is a screen early in the interview that asks "Do any of these apply to [name] ?’” where you will do that, and then a drop down will appear where you can enter the date she passed.

 

If you have qualifying dependent children you will be able to file as a qualifying surviving spouse  (QSS) for the next two years after this tax return.  Post back if you need further help.

My return was rejected by the IRS because my wifes ssn was flagged by social security as a deceased person. She passed in Jan of 2023 and I thought I could still file jointly using her SSN, How can I electronically file my taxes this year

Yes, you should have been able to e-file.  There has not been a change to the rules and here is an IRS link. First, double check the social security number (SSN) for accuracy. If it is correct on the return you can try again.  If you find it was wrong and you correct it, file it again by e-file.  Any reject again and you should change to paper and put it in the mail.

The issue may be an identity flag, my advice is to print and mail your tax return with your W-2s and any document that might have any federal withholding. If it rejected for the SSN it's not likely it will go through. There have been many returns filed for deceased individuals and very few have had rejection.
