Filing status

I am married, living separately from my husband who is working in a different state.   I live in Arizona…a community property state.   He is living in Seattle, WA with no State tax.   He will be a resident of Washington for the entire 2023 year.   What is the best way for us to file?   I would qualify for Head of Household.

Hi, @Cjlewis , thanks for the question! This is a fairly complex question.

 

Based on the information provided, I'm not sure that you qualify for Head of Household Federal filing status. You can try this IRS tool to make sure. 

 

As to Married Filing Separately, this is a very complex filing status in community property states. 

 

Given that, Married Filing Jointly might be the most advantageous, though this can be affected by many factors as well.
