Filing Status with deceased husband

My husband passed away on January 4, 2023.  I filed our taxes as Married filing jointly and reported his death for tax year 2022.  In 2023, he received $307 from Social Security that they said he was due via the usual direct deposit.  I received a lump sum Retired Death Benefit check which was taxed by both Federal and State.  ($500.00 less $115.00) and a check for monthly allowance payable from the 1st of the month through the date of his death for $495.84.  No taxes withheld.

 

My question is, do I file as Married filing jointly again for tax year 2023 and do I report this as his income?

Yes, file jointly and report all 2023 income. When you complete your return put your name as taxpayer and his as spouse. You will be able to report the fact and date of his death on the return.

Very sorry for your loss.   I am confused by this----you say your spouse died on January 4, 2023. 

"My husband passed away on January 4, 2023. " 

 

 

But then you say

 

".......reported his death for tax year 2022.  .."

 

If he did not pass away until 2023, why did you report his death for 2022?   To whom did you report his death?

 

If your spouse passed away in 2023, you can file a joint tax return for 2023.

 

 

 For the year that your spouse died, you can still file a joint return.  That way, you will get the married filing jointly standard deduction of $27,700 (+ $1500 for each spouse 65 or older) which will lower the amount of income you are taxed on.

 

In My Info, you will need to indicate that your spouse died. When his name is in My Info,  there is a screen early in the interview that asks "Do any of these apply to [name] ?’” where you will do that, and then a drop down will appear where you can enter the date he passed.

If you have qualifying dependent children you will be able to file as a qualifying surviving spouse  (QSS) for the next two years after this tax return.  Post back if you need further help.
