I have read all the posts related to this topic. I have found 5329 in Forms Mode and filled it out with the statement for the waiver. Do Not File is printed in red at the top of the form. I can see it in my list of forms, but it says Not Done next to it. Will it really be included when I e-file? My husband will not receive a 1099-R for 2023, because his distribution was not processed until January 2, 2024.

This reply did not answer my question. Am I going to have to mail in our entire return, because we need to include the 5329? I understand that if I was using the web version, I would have to do this, but I am using the desktop version.
For desktop version: You can efile.
Enter the forms mode and click on open form. Type in 5329. Choose 5329-T for the taxpayer (first person listed on your tax return), or 5329-S (for spouse - 2nd person on tax return).
Scroll down to Part IX line 52 and enter the RMD amount that should have been taken. On line 53 enter the amount of the RMD that was actually taken (probably zero if it was missed).
Then in the box right under line 53 "Waver of Tax Smart Worksheet" enter the same amount as line 52 (the RMD amount). Then click the "Explanation" button and enter the reason for missing the RMD and your statement requesting a waver.
You will not pay any penalty now until the IRS determines if it will grant the waver, then they will inform you if you owe the penalty.
Thank you. I went to the e-file page and selected forms for filing and it did show 5329 in the list. The Do Not File that is printed at the top of the form is disturbing.
Apparently the form won’t be ready until January 24.
Turbotax 2024 CAN'T HANDLE A MISSED IRA RMD WITHDRAWAL . It will not trigger a form 5329 to request a penalty waiver if you indicate a $0 withdrawal for your RMD. If you prepare the form 5329 yourself it will not include it in your required docs to be filed E or mailed. It keeps telling me to file later because they are working on this problem, as if this was rare. According to published data from IRS every year there is around 28% of filers that have a shortfall in their RMD's and need to file form 5329 to report it. WHAT HAS TURBOTAX BEING DOING ALL THESE YEARS?????? Its a very simple problem to solve just add a trigger to the software for this form whenever they
they see a shortfall in the step by step questions! Meanwhile I can't file my tax return with E file because they will not support this form so the only thing I can do is print the 1040 with docs supported and then print the 5329 separately and mail both together to the IRS. Be careful with answers online which says it will file the 5329 unless they are telling you how and you have tested. Most of the time they don't answer the question if it can be filed but instead explain how you can prepare yourself the form if you have the desktop form of the software which is not the question! I wonder if people who answer to questions or complaints EVER RED THE ACTUAL QUESTION.
BOTTOM LINE YOU CAN'T E FILE WITH A FORM 5329 INCLUDED IN TURBO TAX. PERIOD! You will have to print all your tax docs and file to the IRS by mail.
I was able to use Turbotax last year to add the 5329. I couldn't add it right away, because Turbotax didn't have it available yet.
