You have not mentioned whether you are self-employed or if you are a W-2 employee, nor have you told us how much you earned.  We do not know the ages of your children.   Provide some details if you want an answer.   Or use the TaxCaster tool.

I am a stay at home mom.

If you are a "stay at home mom" then how are you and the two children supported?  Income tax refunds come from working and paying tax and/or refundable credits which you get from working.  If you do not work and earn any income, there is nothing from which to issue a tax refund to you.   Is there someone else who will be claiming you and the children as dependents?

Let's clarify which tax year you are asking about.   For tax year 2022, you are not eligible for any sort of child-related credits or income tax refund unless you worked and earned taxable income; then you could be eligible for earned income credit and perhaps the child tax credit for children under the age of 17.

 

For tax year 2021 if you can claim your children as dependents you may be eligible for the child tax credit and the recovery rebate credit for the qualifying children that you claim as dependents.   Those credits are available even to a parent who did not earn any income--but only for 2021.

I am not married and my boyfriend works so he is the one that makes the money but he owes back child support and doesn’t the irs take backed owed child support

@lilerica45 If your BF owes back child support then his tax refund can be seized for the child support he owes.   And..sorry, but if you do not work or receive any taxable income, you have nothing to enter on a 2022 income tax return, so you are not going to get a refund.

 

You still have not clarified whether you were asking about tax year 2021 or 2022.   If you are asking about tax year 2021, then for that year ONLY, you could file a 2021 tax return even if you had no earnings, and claim your own children in order to get the child tax credit and/or the recovery rebate credit for them.  That would only be for 2021.   For 2022, next year, you will not be eligible for any child-related credits since you say you did not work.

 

If your BF already filed a tax return and claimed your children, then you have another problem....the children cannot be claimed on two tax returns.   Did he claim them?   Is he their bio-dad?   If he already claimed them and received a refund for claiming them---even if the refund was seized for his delinquent child support--- then you have a very messy issue.   Please provide some details.

I am talking about taxes for 2022 - I did the estimator tax return on turbo tax and it was saying that I would get money back. I am head of household and I have two children to claim. I have not worked and I am the only one who has claimed my children no one else has never claimed them. I don’t want to have my BF claim them because I don’t want that money taken for back child support

A 2021 tax return is the only tax return on which you can get child tax credit or the recovery rebate credit.   If your BF did not file a 2021 tax return that claimed your children then you can file a 2021 tax return and claim them in order to get those credits.   If you have not worked in calendar year 2022, then filing a 2022 tax return next year will not help you.   You will not get any sort of tax refund for tax year 2022.  A 2022 tax return would be filed in early 2023.   It is not clear what "estimator" you used or when you used it.   If you did not work in 2022, you cannot get a tax refund for 2022 by filing a 2022 return in 2023.

 

If you need to file a 2021 tax return, do so before e-filing closes on October 17, or you will have to print, sign and mail your return---and it is taking the IRS six to nine months to send refunds for mailed returns.
