Do I qualify for the EITC? I am married filing separately, have 2 children, living apart since Nov. and Legally separated since Feb. 2022.

My spouse moved out November 11
I have full custody of both children and will be claiming them. We legally separated in February 2022.

Even if I am filing married filing separately? And we were not legally separated until 2022? Thank you for your answer!

It is hard to qualify for EITC when MFS with no children, but you are not in that situation.

You can't qualify for an earned income tax credit if you file as married-separate. Also, you can't file as a head of household in 2021 unless your spouse did not live with you for the last six months of the year.

 

So, the only way for you to get the earned income credit for 2021 is to file as married-joint.

The rules have changed for 2021.  Read the new rules for separated spouses under Whats New in  Publication 17 (2021), Your Federal Income Tax | Internal Revenue Service (irs.gov)


  • Rules for separated spouses. If you are married but don't file a joint return, you may qualify to claim the EIC if you live with a qualifying child for more than half the year and either live apart from your spouse for the last 6 months of 2021 or are legally separated according to your state law under a written separation agreement or a decree of separate maintenance and do not live in the same household as your spouse at the end 2021.

In your case, you do not qualify because your spouse left in November.  It would be worth filing jointly this year to get the EITC and other credits.

No.  You won't qualify if your filing status is Married Filing Separately.    You were not legally separated on 12/31/21.   You would need to file as Married Filing Jointly or Head of Household.   The problem you will have with Head of Household is that you are only considered single (and therefore eligible to claim the credits) if you lived apart from your spouse for the last 6 months of the year.  

 

To qualify for and claim the Earned Income Credit you must:

 

  • Have earned income; and
  • Have been a U.S. citizen or resident alien for the entire tax year; and
  • Have a valid Social Security number (not an ITIN) for yourself, your spouse (if filing jointly), and any qualifying children on your return; and
  • Not have investment income exceeding $10,000; and
  • Not be filing a Form 2555 or 2555-EZ; and
  • File a return with the Single, Married Filing Jointly, Head of Household, or Qualifying Widower filing status, even if you're not required to file a return.    Note - MFS returns do not qualify for the credit.   

 

Do I qualify for Head of Household?

The link above explains how you can be married and still qualify.   However, you would need to have lived apart from your spouse from July 1 - Dec 31 of the tax year.
