confused on taxes help needed badly

 

Hi  I have a two part question, and I thank anyone in advance for help on this.  In Jan 2021 I received a letter from the IRS about an amount I claimed on my 1040 it is an amount that I get from my husbands pension - he pays by check each month and for the last 10 years I have been claiming it as a pension,  I get no paperwork on this so I just put it in that area as Income.  this year they sent me a letter to clarify where I get this money.  I faxed a letter and a copy of my divorce decree to them on Feb one and still have no response.  they have on my transcript page that I didn't do my 2019 taxes, yet they have my canceled check for proof.  I call twice a week

and no one answer my question.

2nd question - I received SSI for the last month of 2020 but have received no 1099 to show proof of this income - and there is no 1099 on my account page,  I want to file 2020 but I dont know how to prove I got that money for the last month Dec of 2020

 

I am beyond frustrated tried to contact them several times with no luck   any help would be so much help

Glad to help.   First the amount you are getting from your former husband is alimony.  You should enter that amount in the "Alimony Received" topic under the  "Wages & Income" tab in the "Less Common Income" section.

 

Next, the IRS is behind on processing 2019 tax returns.  Even after processing, the systems are not getting updated quickly all due to the Pandemic shutdown and delays in 2020.  Eventually, everything will catch up.  

 

Finally, you say you received an SSI payment "for" the last month of 2020.  When did you actually receive it?  I  assume in 2021.  If that is the case, you will get a 1099 next year to use for your 2021 taxes. 

 

If you wish to verify that no 1099 has been issued to you, you can request a Wage & Income transcript from the IRS using this link that will show what income has been reported under your social security number.  If there is one there you can use that information to file your 2020 return.

 

Also, note that some or none of your SSI may be taxable depending on your total gross income.  Generally, if 1/2 of your social security income when added to the rest of your income totals less than $25,000 then none of your SSI will be taxable.  TurboTax will do all the calculations for you as you enter your income sources.

I did put it under the alimony for the last 10 years, sorry - I dont know how to prove that except I sent the divorce decree with the response     do you think that is enough   thank you

1. You mentioned that you get the alimony from his pension and reported it as a pension, but called it alimony.

 

This may explain the confusion at the IRS for your situation. Unless you receive Form 1099-R, it must not be reported as a pension even though it is coming from his pension.

 

Sending the divorce decree may not be enough if you reported the alimony in the pension section. You may need to amend the prior year to remove the pension reporting.

2. Please contact Social Security to get your Form SSA-1099 or go online. See: Get a copy of your Social Security 1099 (SSA-1099) tax form online
