Hi, me along with my wife and kid lived in US for the full year 2020 and we filed jointly in 2021. By March 2021, we went to India and got stuck there because of Covid wave two when the US consulate was closed for visa stamping. Meanwhile my wife got pregnant and we had a baby born by end of 2021 in India. I had returned to US and now my family is in India. When I file this year for 2021
(1) can i file jointly with my spouse ?
(2) can i claim my elder kid (for whom we had filed in 2019 and 2020) as dependent
(3) can i claim my new born (born in India in 2021) as dependent ?

Yes, you can make the election to file jointly. You can claim your elder child and your newborn child if they meet the requirements to be a dependent.
To make the Election to File a Joint Return:
You will need to obtain an ITIN for your newborn. Your tax return must contain a Form W-7 and it must be mailed.
