Child Custody Agreement

My wife and I are married, we are not separated and we still live together. We are married filing separately because of my wife's student loans. We know it works out better for us this way. 

 

Since we are together we do not have a Custody Agreement. So, we do not know how to answer this question in Turbo Tax. Do we say yes or no to the question about Having a Child Custody Agreement?

 

We do not know how one of us can claim our child and our child care expenses.

Child Custody Agreement

As long as you're both in agreement, you can answer 'No' to that question. If you do Married Filing Separate, only one parent claim the child, and neither parent can claim Head Of Household status.
