Part of the license agreement...easily accessible in the software's Help dropdown  (my Hi-lighting):

 

"2.2 You acknowledge and agree that the Software is licensed, not sold. You agree not to use, nor permit any third party to use, the Software in a manner that violates any applicable law, regulation or this Agreement. You agree you will not:

 

• Provide access to or give the Software or any part of the Software to any third party;
• Reproduce, duplicate, modify, copy, sell, trade, lease, rent or resell the Software;
• Transfer your license to the Software to any other party;
• Attempt unauthorized access to any other Intuit systems that are not part of the Software;
• Permit any third party to benefit from the use or functionality of the Software via a rental, lease, timesharing, service bureau, hosting service, or other arrangement;
• Decompile, disassemble, or reverse engineer the Software.
• Make the Software available on any file-sharing or application hosting service.

well sure he can (and I can sell you the Brooklyn Bridge) , but how are you going to know when you send the money that he hasn't already sold it 20 times and you never get your money back???? I bet he doesn't take a credit card as a payment type......

I have purchased the desktop program from him for at least five years running. And it works every time. So he is probably selling it to four people (not five, just to be safe) and making a tidy profit. So I am asking, is this in agreement with the license he has purchased? That is, is he allowed to do this?

I think this is the first year there is a limit. 

 

Previously, you bought the disk and frankly could load it on to as many PCs as you wanted. 

 

This year, there is the activation code which limits downloading the software onto no more than 5 PCs. 

 

whether it is legal or not is a different issue; I am not a lawyer
